Terms of Service

These terms apply when you hire Moklas (Abdul Momen) for HTML email development. By sending a project brief, accepting a quote, or paying an invoice, you agree to the terms below. If anything here needs clarifying before you commit to a project, email me first: momen@moklas.com.

What's included

I build hand-coded, responsive HTML email templates from the design file or brief you provide (Figma, PSD, XD, AI, Canva, PNG, PDF, a rough sketch, or a description). Every build is tested across 60+ email clients and devices, including Outlook and Gmail. Work is delivered white-label under your name; an NDA is available on request.

Scope of work

I reserve the right to decline any project, in whole or in part, that involves content I'm not willing to produce, including but not limited to alcohol, gambling, or other content outside my personal or professional standards. This is assessed on a per-project basis and communicated before work begins.

Quotes and pricing

I reply with a fixed quote within 12 hours of receiving your brief, usually sooner. That price stays fixed once agreed, and won't change unless the brief itself changes. If your scope changes partway through, I'll tell you before doing any additional work, not after.

Turnaround

Standard delivery is 48 hours, Priority is 24 hours, and Rush is 6-12 hours for tight deadlines, subject to availability at the time you send your brief. The tier you need is confirmed when you send your brief.

Nonprofit and discounted pricing

Registered nonprofits and social-good projects get up to 30% off. Mention it when you send your brief and I'll confirm the discount along with your quote.

Revisions

Every project includes 3 rounds of revisions. In practice, I keep refining until you're happy with the result, the 3 rounds are the formal baseline, not a hard cutoff.

The 30-day guarantee

If anything renders wrong after delivery, in Outlook, dark mode, mobile, or any client, I fix it free within 30 days of delivery, no extra charge. For repeat clients, that fix window isn't limited to 30 days; if something breaks later, tell me and I'll sort it out.

Payment

Payment terms are confirmed with your quote before work begins. If you're working with me through Fiverr, payment and any Fiverr-specific terms are handled through that platform. Outside of Fiverr, payment is arranged directly and confirmed in writing before the project starts.

Ownership

Once a project is paid in full, you own the final delivered code and can use it however you need, resell it, hand it to your team, or ship it under your own brand. I don't reuse or repurpose your specific template design or branded content for anyone else.

Confidentiality

Design files, briefs, and client details you share with me are kept confidential and used only to complete your project. This is a normal part of white-label work, and a signed NDA is available any time you'd like one in place before sharing files.

What I need from you

Accurate source files or a clear brief, timely feedback during revisions, and a response within a reasonable time if I have a question about the scope. Delays on your end (late feedback, late files) can shift the delivery timeline accordingly.

What I'm not responsible for

Once delivered code is handed off, I'm not responsible for how it's implemented, sent, or modified on your end, including changes made by someone else after delivery, ESP-specific sending issues unrelated to the template's own code, or deliverability/inbox placement outcomes, since those depend on your sending reputation and infrastructure, not the template itself.

Cancellations

If you need to cancel a project after work has started, contact me directly and we'll sort out a fair arrangement based on how much work is already done. There's no need to guess, just ask.

Changes to these terms

If I update these terms in a meaningful way, I'll update the date at the top of this page. Terms in effect at the time you accept a quote are the ones that apply to that project.
